Meeting with the German Federal Bar (BRAK), the German Chamber of Commerce and Industry (DIHK), and the German Arbitration Institute (DIS)
On December 12, 2024, the Vietnam International Arbitration Centre (VIAC) welcomed and held discussions with representatives from the German Federal Bar (BRAK), the Association of German Chambers of Industry and Commerce (DIHK), and the German Arbitration Institute (DIS).
The VIAC delegation included Mr. Chau Viet Bac - Vice Secretary-General of VIAC, Ms. Hoang Nguyen Ha Quyen - Managing Partner of LNT & Partners, Listed Arbitrator of VIAC, Mediator of VMC and Ms. Bui Thi Yen Trinh - Deputy Manager of Promotion and Training Department of VIAC. On the German side, the meeting was attended by Dr. Ulrich Wessels, President of the German Federal Bar, and Dr. Stephan F. Wernicke - Chief Legal Officer, the German Chambers of Commerce and Industry, along with other foreign lawyers.
During the meeting, both sides discussed the practice of resolving disputes through commercial arbitration in Vietnam and Germany. The BRAK and DIHK’s representatives expressed significant interest in Vietnam’s arbitration procedures and VIAC's role in assisting international businesses in resolving disputes efficiently and transparently. It was noted that similar to Vietnam, Germany is undergoing arbitration law reform. Hence, the German delegation appreciated VIAC's insights into the practical advantages and challenges of dispute resolution in Vietnam. Through these discussions, both sides hoped to contribute valuable insights toward improving national arbitration legal frameworks while promoting the development of arbitration and ADRs in the future.
From the perspective of supporting enterprises, the representative of the DIHK shared insights into the needs of German businesses for legal support and advisory services on law and dispute resolution. Dr. Stephan F. Wernicke emphasized that businesses, especially small and medium-sized enterprises, consistently require assistance from organizations and authorities to mitigate legal risks and ensure a stable business environment. As such, DIHK representatives expressed a strong desire for increased collaboration and connection with legal support organizations and dispute resolution institutions to effectively provide guidance and solutions for German enterprises and the broader business community.
Seminar “Provisions and practical application of international commercial arbitration law in Vietnam and Germany”
Following the previous meeting, on December 13, 2024, in Ho Chi Minh City, VIAC’s representative - Mr. Chau Viet Bac - Vice Secretary-General of VIAC, along with VIAC's Arbitrators including Dr. Phan Trung Hoai, Ms. Dinh Anh Tuyet, Ms. Hoang Nguyen Ha Quyen, Dr. Chau Huy Quang and Mr. Nguyen Chinh, participated as moderator and speakers in the Seminar titled “Provisions and practical application of international commercial arbitration law in Vietnam and Germany”. The event was organized by the German Chambers of Industry and Commerce, the German Federal Bar and the Vietnam Bar Federation (VBF), with the moderation of Dr. Do Ngoc Thinh - President of VBF.
During the Seminar, Mr. Bac shared insights on the significant increase in the number of disputes resolved at VIAC in 2024. By December 2024, the total number of cases handled by VIAC had reached nearly 500 disputes, marking an impressive and record-high figure compared to the same period in previous years. He highlighted this milestone as a testament to the potential growth of arbitration in Vietnam while also emphasizing the need for continuous improvement in the legal framework to facilitate the proceedings and mitigate risks as arbitration becomes more prevalent.
Additionally, based on VIAC’s statistics, Mr. Bac noted that Germany currently ranks fifth among countries involved in disputes handled by VIAC. Therefore, he stressed the importance of events that give opportunities for experience sharing between Vietnamese and German lawyers; such events serve as vital bridges, helping the German business and legal communities better understand arbitration and ADR practices in Vietnam. At the same time, these exchanges provide VIAC with valuable feedback from international lawyers, enabling improvements in arbitral procedures and enhancing the quality of dispute resolution.
Beyond dispute resolution through arbitration, VIAC has also made significant contributions to the government, businesses, and legal practitioners through various initiatives, including promotion activities, conferences, workshops, and training programs. Events organized by VIAC and partners not only advance ADR development but also contribute to refining mechanisms and policies, thereby fostering a favorable and secure business and investment environment for enterprises.
