Currently, according to Law on Commercial Arbitration 2010, in the arbitral proceedings, the parties can mediate themselves or request the tribunal to conduct the mediation. On the one hand, it can be seen that this provision facilitate the parties to resolve disputes more harmoniously, and reduce the burden of costs. On the other hand, in the absence of specific guidelines and regulations, the tribunal will be prone to obstacles in the process of coordinating mediation activities. Moreover, this issue may potentially affect the neutrality and impartiality of arbitrators. Aiming to discuss issues regarding the neutral third-party factor – “mediators” in the process of dispute settlement by arbitration from practical perspectives and international experiences, the third specialized workshop within the framework of the Arbitration - Mediation Symposium (AMS 2024) will focus on discussing issues related to Mediation in Arbitral proceedings: Neutral third parties’ roles and influences on resolving disputes. AMS 2024 – SEMINAR: IMPROVING THE MECHANISMS ON THIRD PARTIES TO FACILITATE THE ARBITRATION PROCESS
In the context of increasing disputes and applying Law on Commercial Arbitration 2010 (be abbreviated to “LCA”) over 13 years, many matters of enhancing, completing legal framework of arbitration have been raised and deeply discussed by experts. Apart from other issues relating to arbitral procedures, the matter of disputing parties was also thoroughly considered. In practices, it can be seen that besides of disputing parties (regulated in LCA), third parties have participated in many cases in different roles and they are able to make significant impacts on the effectiveness and rapidity of arbitration. Nevertheless, due to being known as private method and only having effect on the parties whom are included in arbitration agreement clause, the definition, rights and obligations of “third parties” have not been regulated in arbitration legislation, especially in Vietnam. As a result, it apparently has led to a lot of difficulties when resolving disputes. Regarding this problem, in many countries, there have been such suggestions for providing mechanisms for third parties, however, requests for a consensus between the parties in arbitration presented a challenge on above-mentioned suggestions as well as led to many arguments among experts. After the series of three specialized workshops, the Closing Symposium will focus on exchanging views on Completing the third parties’ mechanisms for facilitating the arbitral proceedings. [See more]

Resolution No. 98/2023/QH15 on the pilot implementation of specific mechanisms and policies for the development of Ho Chi Minh City ('Resolution 98') officially took effect, bringing with it the expectations from the government and the business community on the considerable improvement and change in Ho Chi Minh City’s economy. With the purpose of exploiting economic potential and solving existing problems, Resolution 98 introduces many policies and allows enterprises to pilot a variety of new models and new methods. From the perspective of investment promotion, Resolution 98 also shows a breakthrough when introducing a series of new regulations that have significant influence on investors. Due to that importance, the Investment Legal Support Forum 2023 conducted evaluations and contributions from many experts on the regulatory framework of Resolutions 98, focusing on two notable topics: Investment in the form of Public-Private Partnership (PPP) and Investment in “green” projects.
On the basic of synthesizing opinions given in ILS Forum 2023, the 1st Semester of the Investment Legal Support Forum 2024 (ILS Forum 2024) shall go into in-depth discussion on the topic of “Investment through Public-Private Partnership (PPP) under new context of Ho Chi Minh City”. Being implemented within 02 sessions (Preliminary Session and Plenary Session), ILS Forum 2024 will focus on discussing investors’ demands and the possibility of meeting these demands in current policies; thereby giving some recommendations to protect investors’ interests and enhance the role of private sector participating in PPP projects. THE TRAINING COURSE ON MEDIATOR SKILLS
Following the success of the basic courses, the Vietnam Mediation Center is pleased to introduce the Training Course on Mediator Skills (Advanced level) in April 2024. The upcoming advanced course includes theoretical and practical modules, helping participant to systematize specialized knowledge about the skills of a mediator during the mediation process, thereby drawing out effective directions in dispute resolution through mediation. The lecturers participating in the advanced course are all leading mediators and experts in the field of commercial mediation with many years of experience in this field and have also participated in teaching dispute resolution courses for lawyers and businesses for many years. The Ho Chi Minh City International Construction Arbitration Conference HICAC 2024 will be hosted by the Society of Construction Law - Vietnam (SCLVN), Vietnam International Arbitration Centre (VIAC), and the International Law Faculty of Ho Chi Minh City University of Law, with the theme on “Construction contract and International Arbitration – When Legal traditions collide”. With the growth of the country's economy, construction is being seen as one of key sectors undergoing significant breakthroughs and changes over time. However, under this situation, disputes in this sector have been considerably increasing. According to statistics of the Vietnam International Arbitration Centre (VIAC), in 2023, construction disputes saw a significant rise compared to previous periods, ranking fourth among industries whose disputes were handled by VIAC. It can be said that most of the construction disputes have great value and are immensely complicated. These disputes stem from different causes, such as disputes arising from issues on designing and consulting, claims for compensation due to delays or quality failures, and other claims for terminating contracts. Accordingly, within the framework of the HICAC 2024 event, VIAC organized a workshop with the desire to share and discuss some common types of disputes as well as issues arising in the process of resolving construction disputes from the perspective of VIAC's operational practice.
