With a view to developing the competence, knowledge and professional skills of members of the Hai Phong Logistics Association (HPLA) in the context of international integration, based on survey results of the interests of the HPLA’s member businesses, the Journal of Democracy and Law and the Ministry of Justice have collaborated with the HPLA and the Vietnam International Arbitration Centre (VIAC) to organise the In-depth Seminar on Dispute Resolution in Logistics by Arbitration. The seminar was held on November 2nd in Hai Phong City.

The Seminar was attended by Prof. Dr. Le Hong Hanh, President of the Vietnam International Arbitration Centre, Chief Editor of Law & Development Journal; Dr. Truong The Con, Chief Editor of the Journal of Democracy and Law of the Ministry of Justice; Lawyer Duong Quoc Thanh, Director, Managing Partner of ALV Lawyers Law Firm, Arbitrator of the Vietnam International Arbitration Centre; Mr. Le Manh Cuong, Vice President of the Hai Phong Logistics Association; Mr. Bui Thanh Binh, General Secretary of the Hai Phong Logistics Association, along with leaders and staff of numerous law firms, law offices, and members of the Hai Phong Logistics Association.

In his opening remarks, Dr. Truong The Con, Chief Editor of the Journal of Democracy and Law of the Ministry of Justice stated that the seminar was hosted in order to train and provide knowledge on dispute resolution in logistics activities for members of the Hai Phong Logistics Association; develop professional skills in arbitration for staff in legal or dispute resolution fields of the Hai Phong Logistics Association to avoid risks; and improve the competitiveness of the Hai Phong Logistics Association’s members against the backdrop of international integration and fierce competition.
Addressing the Seminar, Mr. Le Manh Cuong, Vice President of the Hai Phong Logistics Association noted that there have been disputes in practice where the parties could not reach an agreement even after numerous stages and a prolonged period of time, and eventually the dispute had to be brought to the Court to be resolved. Delegates look forward to the panelists discussing the legality and enforcement mechanism of arbitration awards, so that businesses can better understand and be more confident when chosing arbitration to resolve disputes.

Regarding the key issues mentioned above, Prof. Dr. Le Hong Hanh, President of the Vietnam International Arbitration Centre, Chief Editor of Law & Development Journal and Lawyer Duong Quoc Thanh, Director, Managing Partner of ALV Lawyers Law Firm, Arbitrator of the Vietnam International Arbitration Centre speaking at the Seminar have discussed (i) an overview of disputes and dispute resolution methods in logistics activities; (ii) some general issues on resolving disputes in logistics activities by commercial arbitration (conditions for disputes to be resolved at arbitration, arbitration process and procedures; the selection, appointment and change of arbitrators, etc.); (iii) dispute resolution skills in logistics activities by commercial arbitration (skills in preparing claims and lawsuit documents; skills in researching and drafting documents; requesting interim measures; skills in participating in dispute resolution council meetings, etc.); (iv) some notable issues in dispute resolution by arbitration in logistics activities.
Overvew of the Seminar
At the Seminar, delegates from HPLA member businesses have proactively engaged in the discussion and brought forward questions to clarify and resolve existing problems in disputes emerging from logistics services, and to make out the details of the arbitration process, thus assisting their businesses’ dispute resolution at arbitration.

After the Seminar, the VIAC delegation also visited the headquarters of the Hai Phong Logistics Association and exchanged with the Association’s Board of Directors about VIAC’s activities toward accompanying the Vietnamese business community in commercial and investment activities. This is also one of the key goals of VIAC, in addition to providing dispute resolution services through arbitration, commercial mediation and other alternative dispute resolution methods (ADR) as prescribed by law./.
